Your rights, collecting societies and IFPI
What the two rights questions in the Creator Agreement mean, and what to answer if you're not sure.
Two questions, two different rights
When you accept the Creator Agreement you are asked two things. They are about different rights in the same track:
- The song — the music and lyrics as written. Songwriters are paid for it through a collecting society such as STIM, PRS, ASCAP or BMI.
- The recording — the master, the actual audio. Whoever owns it is paid when it is played in public. In Sweden that money is claimed through IFPI.
You keep both. Neither answer gives Fablesh any right beyond what the agreement itself says.
Are you a member of a collecting society?
Only fill this in if you are actually a member of one: as a songwriter (STIM, PRS, ASCAP, BMI, SESAC or similar) or as a performer (SAMI or similar). Membership is something you apply for and sign; releasing music through a distributor doesn't make you a member. If you don't remember joining, leave it empty.
It changes nothing for you. It tells us whether we owe your society a licence before your music goes on the radio.
Who claims your recordings with IFPI?
IFPI here means the Swedish claim for public performance of a recording — on the radio, for example. Outside Sweden the same kind of right is handled by other organisations, such as SoundExchange in the US or PPL in the UK.
- Nobody yet — the right answer for most independent artists.
- I do, as an IFPI member — you have joined IFPI yourself and claim your own recordings.
- My label, or a neighbouring-rights service, already claims them — someone holds a written mandate to collect performance money for these recordings.
- I'm signed to Crystal Pier Records or Fablesh — you have a separate label contract with us.
Distribution is not a claim
Getting your music onto Spotify, Apple Music and the rest through DistroKid, TuneCore, CD Baby, Releese or similar is distribution. Content ID and social-media monetisation on YouTube, TikTok or Instagram are not IFPI claims either.
If that is all you have, answer “Nobody yet” — unless you have separately signed up for neighbouring-rights collection.
Nothing is claimed twice
Fablesh and Crystal Pier Records claim with IFPI only the recordings they own, and those of artists signed to them. If you're not signed to us, we never claim your recordings, whatever you answer — so a wrong guess can't lead to a duplicate claim from our side.
If you are signed, the answer matters: the label claims on your behalf only with your separate permission, which you can withdraw at any time.
